PLAN COMMISSION MINUTES

August 22, 2005

 

Chairman Ed Sedor called the August 22, 2005 meeting of the Town of Peshtigo Plan Commission to order at 6:33 p.m.

 

Plan Commission members attending were Bob Cerrato, Ed Malechuk, Ed Sedor, Dick Seils and Karen Sylvester.  Absent were Bruno Brysiewicz and Tom Fetterly.  Also attending were Jerry Kobishop, Doug Wagner, Lou Ellen Stiebohr and her business associate, one Town resident and Dave Thibodeau of the Peshtigo Times.

 

A motion was made by Seils and seconded by Malechuk to approve the agenda as printed.  The motion carried with all in favor.

 

A motion was made by Malechuk and seconded by Cerrato to approve the minutes of the

July 14, 2005 meeting as printed.  The motion carried with all in favor.

 

Announcements

·         The next Joint Plan Commission meeting is scheduled for September 15th

 

Doug Wagner – Pond and Zone Change Request

·         Wagner is requesting a zone change so that he would be able to put in a pond on his property.  The property is currently zoned R-1 and does not allow ponds 

·         Wagner explained he has placed Restrictive Covenants on the development that does not allow farm animals so he is not concerned about being zoned agricultural at this time.

·         Wagner does have a meeting with Marinette County and WDNR on September 7 for approval on the pond as it falls within a wetland area and is in close proximity to a creek.  According to Wagner, on preliminary inquiry Rosenberger from the WDNR sees no problems but suggested leaving a part of the proposed pond as a wildlife pond.

·         Wagner must complete a Conditional Use Permit application to obtain a pond permit.  He would like to begin work on the pond hopefully at the end of October or the beginning of November.

·         Sylvester reported that the Town Board is revising their current pond ordinance that would allow ponds in all zones by conditional use  She suggested that Wagner wait to see if that is passed in which case he would not have to change his zoning but just obtain a Conditional Use permit

 

A motion was made by Sylvester and seconded by Seils to recommend approval of the conditional use to the Town Board for a pond on Lot 6 of CSM 2703 contingent upon the Town Board’s passage of the new pond ordinance and approval from the WDNR and Marinette County.  The motion carried with all in favor.

 

Jerry Kobishop – Pond and Zone Change Request

·         Kobishop is requesting a zone change so that he would be able to put in a pond at Countryside Estates.  The property is currently zoned R-1 and does not allow ponds.

·         Kobishop distributed a sketch of the proposed pond and a letter from Cleveland Gombar an engineer working on the project.

·         Seils wanted clarification on wording on page 2 of the Conditional Use Permit application which reads:  “Build an approximate 2.3 acre pond and fill to stay on site at this time”.  The words “at this time” were crossed out and initialed by Kobishop as he stated the fill would stay on the land and not be removed at any time.

·         Sylvester reported that the Town Board is revising their current pond ordinance to allow ponds in all zones by conditional use.  She suggested that Kobishop wait to see if that the new pond ordinance is approved by the Town Board which would permit him to build the pond on the property.  This would allow Kobishop to keep his current zoning at R-1 which could keep people from buying two or more lots and then permitting them to keep farm animals if the parcel was zoned agricultural  Kobishop wants to keep this an exclusive residential area.

 

A motion was made by Sylvester and seconded by Seils to recommend approval to the Town Board on the Conditional Use for a pond This is contingent upon the Town Board passing the new pond ordinance.  The motion carried with all in favor.

 

Group Home

·         Lou Ellen Stiebohr is seeking approval of a conditional use permit to allow one additional person to live in the new group home located on Shore Drive.  The property is currently zoned as R-1 which allows up to eight residents in a home.  Stiebohr finds that one of the bedrooms in the home is large enough to allow an additional resident and for that reason she is seeking a conditional use permit which would allow nine residents instead of eight.

·         Her original application also asked to move a sign so it would not be in the middle of the driveway however she has since purchased an additional six acres of land to the north so she will now be able to comply with the sign ordinance.  Stiebohr and Sedor both made the deletion of the sign request on the original application and initialed the change.

·         Stiebohr is currently working with the state to receive certification for twelve residents.

 

A motion was made by Seils and seconded by Malechuk to recommend approval to the Town Board on the Conditional Use Permit for one additional resident for a total of nine at the Group Home contingent upon state approval.  The motion carried with all in favor.

 

Discuss Pond Ordinance

·         The Commission reviewed the draft of the Pond Ordinance and made several revisions.

·         Sylvester checked with the WDNR on the definition of a wildlife pond.

·         The WDNR is supposedly paying landowners $10,000 to build wildlife ponds.

 

A motion was made by Cerrato and seconded by Malechuk to recommend approval of the Pond Ordinance to the Town Board.  The motion carried with all in favor.

 

Discuss Zoning Ordinance

·         A meeting is set for September 8th at 10:30 a.m. with Attorney Allan Harvey to work on the Code of Ordinances.  This will include the pond and subdivision ordinances.

 

The next meeting will be held on Monday, September 19, 2005 at 6:30 p.m.                                                                         

A motion was made by Cerrato and seconded by Malechuk to adjourn the meeting at 8:38 p.m.  The motion carried with all in favor.
