COMMISSION MINUTES
July
14, 2005
The July 14, 2005 meeting of the Town of
Peshtigo Plan Commission was called to order by Chairman Ed Sedor at 7:00 P.M.
Plan Commission members attending were
Bob Cerrato, Ed Malechuk, Ed Sedor, Dick Seils and Karen Sylvester. Bruno Brysiewicz and Tom Fetterly were
absent. Also attending was Supervisor
Don Pazynski, Dave Thibodeau of the Peshtigo Times and a number of town
property owners.
Motion by Seils, second by Cerrato to
approve the agenda. Carried.
Motion by Malechuk, second by Cerrato to
approve the minutes of June 6, 2005.
Carried.
During public input Ryan Behnke inquired
if the swimming pool he wants to place on his property would be grandfathered
in because he has a substandard lot consisting of only 0.62 acres, which he
purchased 10 or 11 years ago. The
property fronts 250' along the west line of Shore Drive and is 120' deep. Commission members agreed that the lot is a
nonconforming lot but because the swimming pool is just now being installed it
must comply with the current setback requirements. If this is not possible, the Behnkes must
obtain a variance from the Board of Appeals.
Mr. Behnke was provided with the name and telephone number of the
Chairman of the Board of Appeals.
There were no announcements made.
Lou Ellen Stiebohr told the Commission
about the open house being planned for July 26th at the Group Home
located on Shore Drive. She said she
wants to house nine individuals rather than eight in the home. One of the bedrooms is large enough to sleep
two people rather than the just one as was originally planned. The Group Home is located in the R-1
district. Community living arrangements
with a capacity for eight or fewer people is allowed however nine or more
requires that a Conditional Use permit be obtained. Stiebohr was told she needs to provide the
needed information to the Plan Commission and fill out the Conditional Use
Form, which can be obtained from the Town Clerk’s office. The Plan Commission will hold a joint meeting
with the Board of Appeals so that one meeting can be held regarding a variance
on sign setback and a conditional use permit on the number of residents, which
will be allowed in the home.
Michael Kowalski addressed the Commission
regarding a pond he has been digging since June 2001 and is located on
Cleveland Avenue. The area is zoned
Industrial. Sedor informed Kowalski that
if the pond is being enlarged by more than 10% a pond permit must be
obtained. In addition, Kowalski was told
the pond couldn’t be larger than eight acres.
Kowalski said he would obtain a pond permit as soon as possible.
Kowalski also informed the Commission
about his plans for development on his property. He indicated he would like to split the
property into smaller industrial lots but right now the Town Zoning Ordinance
requires a minimum of two acres. Bob Brumm,
a local real estate agent was with Kowalski and informed the Commission that
some companies coming in may be able to have a holding tank, and if that were
the case, the lot size could decrease to one acre in an effort to get as many
businesses in the area as possible. If
the business needs a conventional septic system the acreage could be 1-1/2 or
two acres. The Commission thanked both
gentlemen for their input.
Jerry Kobishop presented the Commission
with a drawing of a pond he wants to install on the development he has on
Countryside Lane just off Krause Road which is zoned R-1. Ponds are not allowed in R-1 therefore
Kobishop needs to obtain a Conditional Use Permit. Commission members expressed
concern about the possibility of having enough room for the pond as it is shown
on the drawing. Kobishop was told the
maximum size of the pond he can dig is 2.3 acres. It was suggested that the six lots in
question be re-surveyed once the pond has been placed within the area, and that
drawing and the other needed information needed to request a Conditional Use
should be presented to the Plan Commission at their next meeting.
Sedor presented a letter from Building
Inspector, Leo Krivickas to Vernon Dumke regarding roads he is constructing off
Keller Road and Dura Road. Dumke has not
filled out a Town Highway Permit Application and it appears the roads, as they
exist now, do not meet Town standards.
The situation will be monitored and if no action is taken by Dumke to
comply, the Town Attorney may have to file for an injunction.
The Pond Ordinance from the Village of
Suamico was discussed briefly as well as the subdivision ordinance. These items need to be included within the
Code of Ordinances, which is scheduled for completion by September, 2005. It was decided to have a workshop to work on
these items. The subdivision workshop
will be held on Monday, August 8, 2005 at 9 a.m.
The next meeting will be held on Monday,
August 22, 2005 at 6:30 p.m.
