PLAN COMMISSION MINUTES

March 21, 2005

 

The March 21, 2005 meeting of the Town of Peshtigo Plan Commission was called to order by Chairman Ed Sedor at 7:00 P.M.

 

Plan Commission members attending were Bruno Brysiewicz, Bob Cerrato, Tom Fetterly, Herman Pottratz, Ed Sedor and Karen Sylvester.  Ed Malechuk was excused.  Also attending were Naomi Dumke, Pete Cramer, and Dave Thibodeau of the Peshtigo Times.

 

Motion by Pottratz, second by Sylvester to approve the agenda.  Carried.

 

Motion by Pottratz, second by Fetterly to approve the minutes of February 7, 2005. Carried.

 

There was no public input.

 

The re-zoning change for the Vern Cramer property (SE1/4 of Section 8, T30N, R23E) was briefly discussed however it was quickly concluded that the needed information which the Zoning Ordinance requires was not available to Commission members.  Therefore the matter was tabled until the April Plan Commission meeting.  Sedor will discuss the missing material with office staff on March 22nd as both Cramer and Dumke informed the Commission members they had presented the needed material to office staff.

 

Sylvester explained what she had been told by Town Attorney, Kim Coggins regarding the issuance of building permits on private roads and easements.  The Towns current Driveway Culvert and Highway Ordinances implies that building permits and fire numbers will not be issued on private roads.  Attorney Coggins considers this a taking of property and has said that these permits must be issued until the matter can be further researched. The Town Building Inspector has been informed.  Attorney Harvey, who is preparing the Town’s Code of Ordinance, will be addressing this item in the code.  Sylvester will keep the Commission apprized of his findings. In addition, Sylvester will draft a letter which will be given to individuals seeking a building permit and whose property is accessed via a private road or easement.  The Commission will modify the letter at the next scheduled Plan Commission meeting.

 

The Plan Commission members will be provided with a copy of the rough draft Subdivision Ordinance which Sedor and Sylvester had been working on several years ago. Each member is asked to review it for the April meeting.

 

The Plan Commission developed the following operational procedures for verbiage changes to the Zoning Ordinance and zoning change requests. 

1.       Individuals requesting property zoning changes or changes to the regulations of the Zoning Ordinance must comply with Section 12.C.1., pages 73 and 74 of the Zoning Ordinance.  All nine items must be presented, in writing, when the request is made to the Plan Commission.  In addition, the Commission must be presented with a check for the fee or a copy of the paid receipt.

2.       All information provided by the requestor must be mailed or provided by hand delivery to members of the Plan Commission one to two weeks before the meeting at which it will be discussed.  

3.       The Commission will handle zoning changes and amendments twice per year in March/April and October/November unless the request constitutes an Emergency.  The emergency must be for a bonafide reason and will be dealt with on a case by case basis.  The Commission must receive a written explanation of the reason for the emergency.

 

Motion by Fettery, second by Pottratz to approve the Operational Procedures.  Carried. 

 

Sylvester discussed changes which need to be made to the Zoning Code within the Code of Ordinances.  Factory Farms must be defined as well as Commercial Firework Sales.  These items are listed as requiring Conditional Use Permits in the Ordinance but they are not defined and should be.  Attorney Harvey has been notified to include these items in the Code of Ordinance.

 

The next meeting is scheduled for Monday, April 25, 2005 at 6:30 p.m.
