PLAN COMMISSION MINUTES

July 19, 2004

 

The July 19, 2004 meeting of the Town of Peshtigo Plan Commission was called to order by Chairperson Herman Pottratz at 6:30 P.M.

 

Plan Commission members attending were: Bruno Brysiewicz, Bob Cerrato, Ed Malechuk, Herman Pottratz, and Karen Sylvester.  Excused were Tom Fetterly and Ed Sedor.  Also attending was David Thibodeau, Peshtigo Times reporter, and four town residents.

 

On motion by Cerrato, second by Malechuk the minutes of the June 28, 2004 Plan Commission meeting were approved.

 

There was no public input.

 

Fred Carl presented a survey of his property located in the SW1/4 NE1/4 of Section 19, T30N, R24E at the corner of Green Gable Road and Rader Road.  Carl is seeking approval to split the 2.58 acre lot into two parcels as there are currently three home sites located on the parcel.  Two of the homes will stay the third is currently being razed.  One parcel is 1.82 acres and the other is 0.77 acres.  It is the 0.77 acre parcel which Carl’s request pertains to. 

 

Carl explained that he called Mr. Wayne Reichel, Chairperson of the Board of Appeals in September, 2002 and asked to obtain a variance for the lot. He was told that the Board of Appeals would not approve it and to not waste his time asking for the variance. Carl provided the Plan Commission with the survey dated September 26, 2002 which he had originally done in order to make his request to the Board of Appeals.  In 2003 the Town was unable to locate proof that we had Village powers and therefore the Commission does not believe we had the authority to approve passage of a zoning ordinance until we officially received village powers. We believe we didn't officially or legally have zoning until the latest zoning book was approved on September 16, 2003.  After considerable discussion regarding the matter a motion was made by Cerrato, second by Malechuk to recommend approval of the 0.77 acre parcel to the Town Board provided Town Attorney Coggins confirms the Commission’s rational.  Motion carried.  Sylvester will contact Attorney Coggins via E-mail.  (Attached to the minutes is a copy of the E-mail exchange.)

 

John Huff of the DNR is seeking recommendation of approval for the re-zoning of a 1.50 acre parcel of land located in Government Lot 2 of Section 33, T30N, R23E.  Huff explained that the DNR purchased approximately 67 acres of land in Section 33.  That there is a home located on a portion of Government Lot 2 and the DNR has been told by their governing State agency to sell the home with minimal acreage.  The 67 acres is currently zoned A-1 Agricultural - Low Density and the DNR would like to re-zone the 1.5 acre parcel whose exact dimensions will later be surveyed to A-2 Agricultural-Rural Residential.  The remaining property is to remain as it is currently zoned.  On motion by Cerrato, second by Malechuk a recommendation will be made that the Town Board approve the re-zoning of the 1.5 acre parcel to A-2 Agricultural-Rural Residential.  Motion approved.

Richard Peterson of W847 Leaf Road whose telephone number is 735-6522 requests that a four acreage parcel located within the W22 acres of the NW1/4 NW1/4 of Section 31, T30N R24E (Parcel Number 024-1927) be re-zoned from  A-1 Agricultural - Low Density to  A-2 Agricultural-Rural Residential.  Mr. Peterson came to the Commission with none of the information needed to begin the process.  A copy of the map and the legal description for the property in question was obtained and some of the information needed was obtained from Peterson on the spot.  Based on the information verbally presented by Peterson a motion was made by Malechuk with a second by Brysiewicz that the four acre parcel be re-zoned to  A-2 Agricultural-Rural Residential.  Motion carried.  Hence forth all individuals inquiring about zoning requests must be provided a copy of pages 73 and 74 from the zoning book and the clerk or his designee must apprize individuals seeking zoning changes that the information must be completed in total for presentation to the Plan Commission or the request will not be acted upon.

 

The commission members then worked on revising the Zoning Map.

 

The next meeting is scheduled for Thursday, August 12, 2004 at 6:30 P.M.

 

Motion to adjourn by Malechuk, second by Brysiewicz.  Carried.  Meeting adjourned at 8:30 P.M.
