PLANNING COMMISSION MINUTES

June 17, 2004

 

The June 17, 2004 meeting of the Town of Peshtigo Planning Commission meeting was called to order by Town Chairperson Herman Pottratz at 6:45 P.M.

 

Plan Commission members attending were, Bruno Brysiewicz, Tom Fetterly, Herman Pottratz, Ed Sedor and Karen Sylvester.  Bob Cerrato and Ed Malechuk was excused.

 

On motion by Sedor, second by Brysiewicz the minutes of the May 24, 2004 Plan Commission meeting were approved.

 

There was no public input.

 

Commission members discussed the future land allocation map exercise which were individually suppose to develop for the July 13, 2004 meeting of the Joint Plan Commissions.  Under discussion were general concepts regarding commercial development, town houses and condominiums.  All the members attending felt the Town in the would be bedroom communities to the cities of Marinette, Peshtigo and even Green Bay.  In general it was a very enlightening and insightful conversation.

 

Chairman Pottratz informed the group that he felt the Town should develop a simple and concise subdivision ordinance which incorporation the current highway and driveway/culvert ordinances.  Sedor and Sylvester will attempt to develop something that is acceptable to the commission in the next several months.

 

There was a brief conversation regarding the development of the hiking and biking trail on the Town owned Shore Drive property.  Pottratz stated that Ed and Bob Kowalski along with Trygve Rhude abd Wendel Johnson are responsible for development plans while the Town will do the work.  This will be open to all Town residents.  No motorized vehicles will be allowed/  At a previous meeting of the Joint Plan Commission, Sedor and Fetterly thought they heard John Huff, of the DNR and also a Town resident, make a statement regarding a grant having been given the Town for development of the walkway.  No one on the Commission of Board is aware of any such grant therefore Sylvester will contact Mr. Huff and ask for clarification of the statement.

 

Pages 1 through 49 were reviewed by the members attending.  The following changes were suggested:

1.                   Develop a new front cover removing the listing of Town Officials.

2.                   Develop an acknowledgment page for all who participated in the development of the ordinance.

3.                   Page 5.  Home Occupation.  Change page 70 to page 55.

4.                   Page 7.  Add the following definitions:

 

Nonconforming lot.  A lot whose width, area or other dimension did not conform to the regulations when this ordinance became effective.

 

Nonconforming Sign.  A sign or sign structure or portion thereof existing at the time this ordinance became effective, which does no now conform.

 

Nonconforming Structure.  A building or structure or portion therof lawfully existing at the time this ordinance became effective, which was designed, erected or structurally altered for a use that does not conform to the zoning regulations of the zone in which it is located.

5.                   Page 10.  Include drawing to illustrate the meaning of the front, side and rear yard definitions.

6.                   Page 12.  Item 7.  Change Board of Appeals to read Plan Commission.

Item 7.c.  Should read: Hospitals and clinics, but not animal hospitals/clinics or veterinary services.

7.                   Page 13.  Item B.10.  Change the 10 to a 2 and have it read as follows:  All non-conforming lots of record as such at the time of the passage of this ordinance shall be grand-fathered according to the original Zoning Ordinance.  (Note: we need a like statement for structures and signs.)

8.                   Page 14.  Item D.4.a.  To read: Detached accessory buildings shall be located in the rear yard.  SeeC-1 Conservancy Overlay District in Section 4.D.6.

9.                   Page 15.  Item g,1  Check with City of Peshtigo regarding the setback of fences and modify as necessary.

Item E.1.d.  Add the word “Highway” before Business District.

10.               Page 17.  Item 4.  Board of Adjustment should be Board of Appeals.

11.               Page 22.  Delete item 18 regarding artificial lakes and ponds.

12.               Page 23.  Item 3.  Side Yard and Rear Yard Setback – add to each Principal Building.     Item 4.  Building Area.  The 800 square feet should be 1,000 square feet. 

Item 2.  Add the word “farmland” to …while properties for the keeping of animals shall require a minimum of 5 acres.

13.               Page 24.  Item c.7.  Delete as it is regarding artificial lakes and ponds.

14.               Page 25.  Item 3.  Side Yard and Rear Setback – add to each Principal Building.

15.               Page 26.  Item c.7.  Delete as it is regarding artificial lakes and ponds.

16.               Page 27.  Item 3. Side Yard and Rear Setback – add to each Principal Building.

17.               Page 28.  Item c.7. Side Yard and Rear Setback – add to each Principal Building.

18.               Page 29.  Item 3.  Add to Side Yard and Rear Yard Setbacks on both single and two family and multi family dwellings: Principal Building.  Item 4.  Building Area to read:  The total minimum living area per unit of a dwelling shall be 1,000 square feet excluding garages and decks.

19.               Page 34.  Item c.4.  Delete as it is regarding artificial lakes and ponds.

20.               Pages 34 through 37.  Question should they remain to monitor locations of adult book and toy store locations?  Sylvester will ask Attorney Coggins.

21.               Page 38.  Item d.3.  Side Yard and Rear Yard Setback – add to each Principal Building.

22.               Page 41.  Item 14.  Delete as it is regarding artificial lakes and ponds.  Item d.3.  Side Yard and Rear Yard Setback – add to each Principal Building.

 

Motion was made by Sedor, second by Sylvester to recommend to the Town Board the adoption of a revised Ordinance banning nude dancing in bars.  Carried.

 

A discuss was held regarding building permits and why the permit is not displayed as it should be.  Sedor felt that based on page 41 of the Zoning Ordinance, that LaCourt Concrete construction should have come before the Plan Commission and did not. Sylvester discussed accessory building in front and side yards.  It is hoped that the Building Inspector may be able to attend the next meeting.  Pottratz informed the group that in many cases the Building Inspector is a member of the Plan Commission.

    

The next meeting is scheduled for Monday,  June 28, 2004 at 6:30 p.m.  Items for the agenda include: Review of pages 50 of the Zoning Ordinance to the end, review pages 34 through 37 of the Zoning Ordinance, Building Inspector to answer questions, apply zoning classifications to Zoning map, and Shore Drive Trail and clarification of possible grant..

 

Motion to adjourn by Fetterly, second by Brysiewicz.  Carried.  Meeting adjourned at 9:05 P.M.
