PLANNING COMMISSION MINUTES

October 5, 2004

 

The October 5, 2004 meeting of the Town of Peshtigo Planning Commission was called to order by Acting Chairperson Ed Sedor at 6:30 P.M.

 

Plan Commission members attending were: Bob Cerrato,  Ed Malechuk, Ed Sedor and Karen Sylvester Herman Pottratz was attending a Peshtigo City Council meeting and arrived at the meeting later in the evening.   Tom Fetterly was excused.  Bruno Brysiewicz was absent.    Also attending were several town residents.

 

Motion by Cerrato, seconded by Sedor to approve the minutes of the August 12, 2004 meeting.  Carried

 

Motion by Malechuk, second by Sedor to approve the minutes of the September 7, 2004 meeting.  Carried

 

There was no public input.

 

A representative from All American Homes distributed a site plan for the Barbara Kakuk property at W2580 County Road B described as part of the NW1/4 SE1/4, Section 29, T30N R23E (parcel number 024-1589.000).  Considerable discussion ensued regarding the original variance by the Board of Appeals dated September 14, 2000.  The Board of Appeals recommended approval to the Town Board for Kakuk, then known as Barbara Kmecheck, to remodel the garage located on her parcel for an upholstery business.  In the spring of 2001 the sewing machines for the business were moved into the home because of flooding in the garage.  The saws used in the business remain in the garage.  It appears the Town Board never approved the recommendation of the Board of Appeals.  Kakuk is now asking the the Plan Commission to approve the placement of a new home on the existing parcel which will be used as the future family dwelling, converting the current family dwelling located on the site to business and using the garage formerly used for business purposes back to a private garage.  The Plan Commission determined that Kakuk cannot use a separate building for business purposes only.  The Town Zoning Ordinance allows “Home Occupations” within the A-1 District.  If current family dwelling is converted to business usage it would not longer be classified as a home occupation according to the definition in the Zoning Ordinance.  Therefore, Kakuk and the All American Homes representative have agreed to locate the new home as an extension/addition to the current residence thereby creating a large single family residence.  The Commission instructed Kakuk that should a separate structure is ever used for business, the property must be re-zoned to Business.  Kakuk was reminded that the Town Board must approve the use of the home occupation as soon as possible.  The Town Board meeting being held on October 26, 2004 was suggested.

 

Motion by Malechuk, second by Cerrato to recommend to the Town Board the development and passage of an ordinance or resolution which would require a security deposit to remove existing dwelling on a parcel of land within six (6) month of occupancy to the new dwelling.  Approved unanimously.

 

Sylvester will develop a list of parcels which have two or more residences or a business and a residence on one parcel.  The list will be based on information received from Town Assessor, Ron Walters.  This list will be given to Town Clerk, Clarence Coble and Leo Krivickas, Town Building Inspector to monitor furute title transfers.  In addition, a letter will be developed stating these multiple dwellings can remain on the parcel until title is transferred, at which time the parcel must be split of the secondary dwelling removed from the home site.

 

Clarence Coble presented information regarding the development of the 2 C’s Game Farm Campground.  The campground will be located in the W1/2 NE1/4 of Section 7, T29N R23E on the property currently zoned A-1, Agriculture-Low Density.  According to Section 4 of the Zoning Ordinance developing a campground is a conditional use.  Pottratz recommended approval to the Town Board for the campground provided the Conditional Use Form is completed.  Second by Cerrato.  Carried.

 

Seferal re-zoning requests ere presented.  All individuals are hoping that the Plan Commission will modify the Zoning to R-1 Residential.

The area behind his private home located on Autumn Lane in the SE1/4 SW1/4 for Section 23, T30N, R23E.

The SE1/4 SE1/4 of Section 26, T30n R23E.

4.      Lorraine M Evans by her representive Terrie Thomas-Dale.

         Parcel 024-2276 located in Section 19, T30N R24E.

5.      Patricia Peterson-Bilotto

         Parcel 024-3383 comprised of 3.3 Acres in Assessor Plat 6.

 

These zoning changes will be delt with at the nest meeting of the Plan Commission as time did not allow the Commission to work on the zoning map.   

 

The next meeting is scheduled for Monday, October 18, 2004 at 6:30 p.m.

 

Motion to adjourn by Malechuk, second by Pottratz.  Carried.  Meeting adjourned at 8:03 P.M.
